These Terms and Conditions of Sale apply to registration and orders made by any person (hereinafter the "customer") on the website www.lebeaujean.fr (hereinafter the "site") and express the obligations of the parties.

The site is published by the company Mad In Blue (hereinafter MIB), SAS with share capital of €12,500 whose head office is located at 36 rue Paul Cézanne, 68200 Mulhouse, France, registered with the Mulhouse RCS under number 478 099 575.

The site www.lebeaujean.fr is open to all users of the Internet network.

Any order for clothing products (hereinafter "products") presented in the site's store requires prior consultation of these general terms and conditions of sale (hereinafter "GTC") and their unreserved and irrevocable acceptance without handwritten signature of this document.

On the website www.lebeaujean.fr, contracts are concluded exclusively in French. The customer declares that they have the capacity to conclude this contract, i.e. to be of legal age, eighteen years old, and not to be under guardianship. Minors may only place an order with the authorization of their legal representatives. The term "customer" may refer to both a consumer and a professional. The parties agree that their relations will be exclusively governed by these General Terms and Conditions. If a condition of sale were to be lacking, it would be considered to be governed by the practices in force in the distance selling sector, whose companies have their headquarters in France.

MIB reserves the right to adapt or modify these T&Cs at any time. It is agreed that in the event of modification, the version of the T&Cs applicable to any order is the one appearing online on the site on the day the order is placed.

Products

In accordance with Article L. 111-1 of the Consumer Code, the MIB company presents on the site the products for sale and their characteristics. The customer has the possibility of knowing, before the final order is taken, the essential characteristics of the products he wishes to purchase.

The in-stock offers presented are valid as long as they are visible on the site in question, within the limit of available stocks. In the event of unavailability of the product, the mention "In the process of being restocked" will be indicated on the site.

Following the selection of the desired product(s) and the completed order form, the customer has the possibility to check the specifics of the order and to modify it. The "pay" button allows you to confirm the order of the goods contained in the basket and then becomes final. We will acknowledge receipt of your order by an order confirmation sent automatically by e-mail to the address you have indicated. Any placing of an order constitutes acceptance on your part of the prices and descriptions of the products that you have placed in your basket.

The products are described and presented with the greatest possible accuracy. However, if errors or omissions may have occurred in this presentation, the seller cannot be held liable. The photos representing the products are for information purposes only. These photos, like the texts illustrating the products, do not form part of the contractual scope.

Price and payment

Prices are indicated in euros and are only valid on the date of validation of the order by the customer. Mad In Blue reserves the right to modify them, without notice, at any time, it being understood that the invoicing of the products will be done at the rates in force at the time of registration of the order.

They take into account the VAT applicable on the day of the order and any change in the applicable VAT rate will be automatically reflected in the price of the products in the online store.

The prices on the site do not include delivery costs, which are charged in addition and indicated before the order is validated. The prices of products destined for countries outside the European Union are calculated excluding VAT. Customs fees and other taxes in force in the country remain the responsibility of the customer.

Payment of the full price must be made on the day of the actual order.

Telecommunications costs inherent to accessing the site remain the responsibility of the customer.

At the end of the ordering process, payment is made securely via one of the electronic payment modules set up by our partners, Shopify Payments or PayPal, either by debiting the customer's account or by bank card. For payment by bank card, the customer provides their bank card number, associated with its expiration date as well as the cryptogram numbers on the back of their bank card. The precise list of accepted bank cards is notified to the customer during the payment process via the modules. The customer making a payment via one of the modules is deemed to have read and fully accepted the "Privacy Policy", the "Terms of Use" and the "Essential Information on Payment and Service". In this regard, the customer expressly acknowledges that the communication of their bank card number to Shopify Payment or PayPal constitutes authorization to debit their account for the products ordered.

MIB cannot be held responsible for any modifications, erratums, etc. that may appear in the information distributed by one of the payment modules.

MIB reserves the right to suspend or cancel any order and delivery in the event of refusal of payment authorization by officially accredited organizations or in the event of non-payment. In particular, MIB reserves the right to refuse to make a delivery or to honor an order from a customer who has not fully or partially paid a previous order or with whom a payment dispute is in progress.

In the event of fraudulent use of the bank card, the cardholder is invited, as soon as this use is noted, to contact the seller at the following telephone number: 03 89 37 15 85

The computerized records, stored in MIB's computer systems under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties. The archiving of purchase orders and invoices is carried out on a reliable and durable medium that can be produced as proof.

Payment in installments with Alma

Payment in installments is available through our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.

Purchase amount: Only purchases from €100 are eligible for payment in 3 installments with Alma.

Fees: By paying in installments with Alma, the Customer does not pay any fees. Alma is the telepayment manager and issues an electronic certificate which will serve as proof of the amount and date of the transaction in accordance with the provisions of Articles 1316 et seq. of the Civil Code.

Termination: Any termination of the T&Cs binding the Seller and the Customer shall result in the termination of the T&Cs between Alma and the Customer.

Registration on the site

When registering on the site, the customer agrees to provide accurate and complete information. The username and password allowing access to our sites are confidential and must not be disclosed to third parties. Each customer can only open one customer account. MIB reserves the right to delete any multiple registrations without notice and to serve notice on the customers concerned, to terminate their registration or to delete or modify without notice. Registration on the site is free and the customer can terminate it at any time. It is possible to delete a customer account by sending an e-mail with the request to the address bonjour@lebeaujean.fr

Order and delivery

As soon as the order is registered, a confirmation email summarizing the order (products, prices, product availability, quantity, etc.) is sent to the customer by MIB. To this end, the customer formally accepts the use of email for confirmation of the content of his order.

The ordered products are sent to the address indicated by the customer during the ordering process. MIB cannot be held responsible for delays in delivery caused by the indication of an incorrect or incomplete address. Any package returned to the seller due to an incorrect or incomplete delivery address will be reshipped at the buyer's expense. Delivery is deemed to have been made upon delivery of the products to the customer by the carrier, as evidenced by the control system used by the carrier.

Deliveries via Mondial Relay to mainland France are free. Home delivery is offered via La Poste for a fee of nine (9) euros in mainland France. For home deliveries via La Poste or Chronopost, if the recipient is absent when our transport provider visits, the package will be left at a relay point near the delivery address. The customer can collect the package within 10 working days upon presentation of an identity document and, in the case of home delivery, the delivery notice. At the end of this period, unclaimed packages will be returned to the sender. MIB declines all responsibility for delays in delivery caused by the absence of the recipient of the package or their failure to collect it within the time period provided for this purpose.

MIB also offers Express delivery (Chrono 18 via Chronopost) at the customer's expense for certain orders. If this service is offered, it is visible during the ordering process. The amount of Express shipping costs is nineteen (19) euros and is indicated in the shopping cart before validation. Shipping is done the same day for all orders placed before 1 p.m. on working days.

Deliveries to Mondial Relay points to Belgium and Luxembourg are free.

Home deliveries to the French overseas departments and territories and Europe are the responsibility of the customer at a cost of nineteen (19) euros.

Delivery times are indicated when ordering and cannot exceed thirty (30) days. These are indicative times, expressed in working days and corresponding to the average processing and delivery times. The estimated delivery time appears on the product sheet at the time of purchase, and in the order confirmation email.

MIB cannot be held responsible for the consequences of a delay in delivery which is not its fault or which is due to an act of force majeure.

In the event of a delay in delivery compared to the date indicated in the shipping email, the customer is invited to report this delay by sending an email to bonjour@lebeaujean.fr . MIB will then contact the carrier to start an investigation that can last up to 21 days. If during this period, the product is found, it will be immediately rerouted to its destination. If, on the other hand, the product is not found at the end of the 21-day investigation period, the carrier will consider the package lost. Only then will a replacement product be sent to the customer, at MIB's expense. If the product(s) ordered were no longer available at that time, MIB will reimburse the customer for the amount of the products affected by the carrier's loss.

Upon receipt of the products, the customer is required to check the condition of the packaging of the goods and to report any damage caused to the carrier on the delivery note, as well as to MIB, within three (3) days by sending an email to bonjour@lebeaujean.fr .

The customer may, upon request, have an invoice sent to the billing address and not to the delivery address.

Retention of title

The delivered goods remain the property of MIB until receipt of full payment. The retention of title clause does not prevent the risks of loss or deterioration of the goods from being transferred to the customer as soon as they are made available (for consumers) or as soon as they are sent (for professionals).

Right of withdrawal

In application of articles L.221-18 and following of the Consumer Code, the customer has a period of thirty (30) clear days from the date of delivery of the order to exercise his right of withdrawal on his order. This period runs from the receipt of the products by the customer.

The customer must attach to his request for withdrawal a copy of the invoice or any other element allowing the identification of the order in question, and its holder. To exercise the right of withdrawal, the customer must notify MIB of this decision to withdraw from this contract by means of an unambiguous statement (for example, letter sent by registered post or email). The customer can use the model withdrawal form below but it is not obligatory.

Only the customer identified as such with MIB can exercise this right, to the exclusion of any other person, and in particular the person receiving the delivery (for example in the case of a gift).

In the event of withdrawal, MIB will reimburse all payments received (with the exception of additional costs arising from the method of delivery) without undue delay and, in any event, no later than fourteen (14) days from the day on which MIB is informed of the decision to withdraw from this contract. MIB will proceed to the reimbursement upon receipt of the goods using the same means of payment as that used for the initial transaction.

MIB will cover the costs of a single return per order provided that the customer uses the return label provided for this purpose and sent by MIB.

The package must arrive no later than fourteen days after the communication of the decision to withdraw from this contract. This deadline is deemed to have been respected if the goods are sent before the expiry of the period of fourteen (14) days.

Return and Refund Policy

Any exchange or return must be declared by the customer to MIB, by sending an email to bonjour@lebeaujean.fr or via the site's contact form.

The products must be returned by the customer no later than fourteen (14) days after communicating their decision to withdraw and receiving a return shipping label. A copy of the delivery note must be attached. MIB will cover the cost of returning the goods provided that the customer uses the return label provided. Only one return per order will be handled by Mad In Blue. Subsequent returns will be charged nine (9) euros.

The product must be returned by the customer in its original packaging and in perfect condition (suitable for resale, labeled, not worn or washed), to request a refund. Packages in which the invoice or delivery note is not attached and no element allows the sender to be identified (order number, name, first name, address) will not be processed.

If the package is lost or damaged when returning the product, the cost of the damage is the responsibility of the customer. Products that are not returned within the time limits and conditions referred to above will not be refunded by MIB.

MIB does not support returns outside the European Union. All such returns are the responsibility of the customer.

In accordance with Article L. 221-24 of the French Commercial Code, MIB undertakes to reimburse the sums collected for the order within fourteen (14) days. This period begins upon receipt by MIB of the returned products.

The refund will be made by crediting the customer's payment method corresponding to the payment method used to pay for the order.

If the product was acquired through a competition (from the brand or via a partner), the return and refund terms do not apply.

Terms of exchange

If the customer wishes to exchange his product for another product from the site www.lebeaujean.fr (subject to availability), he must request the return of the product ordered and the reimbursement of his order (see return and reimbursement terms above) and place a new order on the site www.lebeaujean.fr for the desired product.

If the product was acquired through a competition (from the brand or via a partner), the exchange terms do not apply.

Conditions of use of promotional codes

The provisions of this article apply only to discount coupons distributed free of charge. MIB may distribute coupons entitling you to a reduction in the price of a purchase, either in absolute value or as a percentage. Each discount coupon specifies the minimum purchase amount and the coupon's validity date. Certain products and brands may be excluded from the benefit of discount coupons.

The credit materialized by the discount coupon does not generate interest, cannot be refunded and is not transferable to third parties. The difference between the amount of the discount coupon and the value of the customer's order can be settled by any means of payment offered on the site.

In the event of a total or partial return of the goods, the fraction of the price paid by discount coupon is not refunded.

General warranty and customer service

In the event of defects in the goods, the customer benefits from the legal guarantees provided for by the legislation in force. Customer satisfaction is essential for the Le Beau Jean brand and the Mad In Blue company. The customer can contact MIB at any time using the customer service contact details listed above. MIB will examine the request as soon as possible and contact the customer after receiving the documents and/or the request or complaint. Processing complaints may take some time, as it often involves contacting the manufacturer of the product. The customer can facilitate the processing of the complaint by describing the problem as accurately as possible, and by sending a copy of the invoice or by indicating the order references (order number, customer reference, etc.). The warranty does not cover defects caused by abnormal or incorrect use or resulting from a cause unrelated to the intrinsic qualities of the products.

Applicable law

These general conditions are subject to French law. In the event of a dispute or complaint, the customer will contact MIB as a priority to obtain an amicable solution.

The customer is informed that any consumer may use a consumer mediator free of charge with a view to the amicable resolution of a dispute with a professional. Consumer mediation applies to any national or cross-border dispute between a consumer and a professional in the context of the execution of a sales contract or the provision of services.

It is possible to contact either a consumer mediator from the list on the consumer mediation website, or to complete the automated complaint form allowing you to contact a dispute resolution body.

The request cannot be accepted by the consumer mediator if:

  • The customer does not prove that he has previously attempted to resolve his dispute directly with the MIB company by means of a written complaint in accordance with the terms provided;
  • The request is manifestly unfounded or abusive;
  • The dispute has been previously considered or is being considered by another mediator or by a court;
  • The consumer submitted his request to the mediator more than one year after his written complaint to MIB;
  • The dispute does not fall within its scope of jurisdiction.

The consumer is informed by the mediator, within three weeks of receipt of his file, of the rejection of his request for mediation.

In the absence of recourse to mediation, the courts of the jurisdiction of the company's registered office will have jurisdiction.

Protection of personal data

The customer is informed and accepts that his personal data may be collected on the site via the Shopify, Shopify Payments and/or Sendcloud platforms and used by MIB which acts as data controller within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter "General Data Protection Regulation" or "GDPR").

MIB undertakes to protect and ensure the security and confidentiality of its customers' personal data in accordance with the GDPR, in particular by taking all necessary precautions to prevent this data from being distorted, damaged or accessed by unauthorized third parties. In particular, customers' personal data may be transmitted to service providers and contractual partners who, as subcontractors within the meaning of the GDPR, intervene and contribute directly to the management of orders and for whom it is absolutely necessary to access the personal data provided by the customer when creating and using their account (identity, postal address, telephone number, email address).

Subcontractors may only act on instructions from MIB. Customers’ personal data is collected for the following purposes:

  • order management and customer relations;
  • customer information relating to offers and commercial information relating to the brand;
  • strengthening and improving website and brand communication by sending, in particular, newsletters and special offers based on customer preferences observed on the site;
  • the improvement and personalization of services offered to customers;
  • compliance with legal and regulatory obligations.

MIB does not store the customer's personal data; it is only kept for the period strictly necessary for the purposes set out above.

In accordance with the GDPR, the customer has the right to access, rectify and oppose personal data concerning him/her, under the conditions provided for by the law of January 6, 1978. To do this, simply send an email to the address bonjour@lebeaujean.fr or by unsubscribing directly from the newsletter or by writing to the following address, indicating his/her surname, first name, email address and customer references at Mad In Blue, 36 rue Paul Cézanne 68200 Mulhouse FRANCE.

Each request must be signed and accompanied by a photocopy of an identity document bearing the customer's signature and specify the reply address. The response will be sent within 2 months of receipt of the request.

The customer may receive, from Le Beau Jean, offers for products or services similar to those already ordered, or newsletters. He/she will have the option at any time to object to them without charge for the future, according to the terms specified in each mailing.

The client may communicate to MIB specific instructions in which the client defines the manner in which he or she intends that the Data Protection Rights and Freedoms be exercised after his or her death in accordance with the GDPR.

Intellectual Property

The website www.lebeaujean.fr is an intellectual work, protected by law. Its content, including texts, illustrations, photographs, presentations and databases are strictly reserved under copyright and industrial property law. MIB grants a limited, non-exclusive, revocable license, without the right to sublicense on the content of the website www.lebeaujean.fr for simple access, navigation and use related to this site. This license does not grant any other right, in particular commercial exploitation of the content of the website www.lebeaujean.fr

The company names, trademarks and distinctive signs appearing on the site www.lebeaujean.fr are protected by French and international laws. Any use, reproduction, distribution or representation of all or part of one of the aforementioned signs, without the express written authorization of the relevant owner, is prohibited.
